RO Letter to Judge Berman

Dear Judge Berman: I write to address the full mobility provision of the proposed collective bargaining agreement between the District Council and the Association of Wall-Ceiling and Carpentry Industries of New York, Inc. (WC&C CBA). I have reviewed the papers and letters submitted by Demian Schroeder, Daniel Franco and other Union members and respond to what I view as the key concerns articulated in the submissions.

My interest in the WC&C CBA, and other CBAS, derives in significant part from my obligation as Review Officer to ensure to the best of my ability that the Union is democratically run and comlption free. In my view, full mobility does not run afoul of these objectives. Indeed, I expect the electronic time entry technology, including its member oversight component, to significantly enhance anti-corruption efforts.

First, the WC&C contract terms, including full mobility, were approved by the District Council in a democratic fashion. As stated in my Fifth Interim Report

On August 22, 2012, the delegate body of the District Council, by a Vote of 60-26, approved terms amending in significant respects the current collective bargaining agreement with [WC&C]. In sum, in exchange for significant wage increases, the employers and the District Cotmcil must develop an appropriate compliance program and obtain an order from the Court to alter the current hiring ratio (“67/33”) to allow employers to select the District Council members who will work for them. The employers will be obliged to match any employee from outside the jurisdiction of the District Council with a District Council member ....

The delegate body was elected by the Union membership in the eight local unions in December 2011, and installed in January 2012, under my supervision.

  2. when did dennis wlsh bcome a delegate. i believe that the monies are to be allocated to either wage/welfare/pension after a vote by the delegates.I spoke to a few delegates and was told that they did not vote on were the monies would go . since when can areveiw officer tell us . dennis is out of order the way he wrote the judge .This letter should not dockrt by the courts .This is his opioin and he can't prove that full mobilty will get rid of corruption . Iam a 29 year member and the only corrution i have heard of is at the top of the nycdcc and is still happening . when did all the stewards take the blame the last time i looked its the boys at the top that are doing jail time GOD WILLING I PRAY THAT THE JUDGE WILL SEE THRU THERE SCAM

Outright ability to discriminate against older carpenters, female carpenters, minority carpenters, outspoken carpenters, activist carpenters, and whistle blowing carpenters is not a corrupt practice? How about the outright ability to hire cousins, brother-in-laws, neighbors, siblings, and the occassional wise-guy over long suffering union-minded carpenters prepared to share the wealth & work while waiting their turn at a shot to feed their families? Is this not a form of currption and/or discrimination? To say this will not happen when it has and will is an insult to the intelligence of all union carpenters.

  4. Institutionalized discrimination and nepotism is a form of corruption! It stands against everything union! This contract creates a Company Union! We stand to lose members in droves!

Dennis Walsh your opinion is flawed. the fact that you worked for Conboy makes you highly suspect.You were given a paycheck by the federal court something you would have never been able to generate on your own which is evident by your lawyering skills and complete lack of objective prescription. If you think IBM is so wonderful why dont you fuck off and go work for them. You can take the retired leeches you call investigators with you. You are a absolute bullshit artist who knows zero about construction and not to much about law as well.Most members didnt send you their letters cause youve done nothing for the membership.Maybe you could get a job working for Bloomberg since your so likeminded.

  7. dennis walsh needs to go. he has not nor will he do anything to help or clean up this union.it is quite apparent he is here only as a lackey for those who wish to destroy our district council.i also am a 29 year member of this union and we are forever open to this govt scrutiny only because of the corruption and bullshit that spews from the top down.isnt that the way shit flows,downhill? may I say that if we members do not get involved we will LOSE our union. everything walsh does is specifically designed to put us out so McCarron can finish siphoning,along with govt others,our monies.PEOPLE YOU ALL BETTER GET INVOLVED FAST BEFORE THERE IS NOTHING LEFT.this is ridiculous. get walsh outta here. he will destroy us given enough time. as for those that are running this dysfunctional organization you all better wake up.you are not the ELITE. you are and always will be,first and foremost CARPENTERS. how fast ye forget.if we let the bosses control thru full mobility,well it is opening the door to greater corruption and less money going into the funds.CLEAN UP FROM THE TOP DOWN.lets get people in office that have not forgotten who and what he/she is.how the can a fucking lawyer know what we deal with from these greedy fucking owners. did he ever stand there and listen to the owner who says that he has work for you but it has to go under the table and when you say no you don't work? the owners, ALL of them are always pushing the envelope,the greedy bastards. they know it and we know it.INTEGRITY this is what will clean up this union not some little bleach blonde measley mouth lawyer.he has no idea what we have to deal with,with these greedy owners.he was handed 70,000to 120,000 dollars a month from OUR MONIES.so what is his interest?helping us clean up or sticking around as long as possible to collect? THINK PEOPLE
