The Final Report of the Review Officer

Federal Watchdog Dennis Walsh
My work has been appropriately concluded. I am largely satisfied with the condition of the District Council, even more so with that of the Benefit Funds. I have endeavored to assist both in the pursuit of a prosperous future for their constituents. That is their solemn responsibility.

Let the bells ring. Though there is much good news, there are those for whom my departure is reason enough for celebration. But I hope that there are also those who reflect on what has been wrought, and on the simple question: what now?

To those who will continue to accept the imperative of working hard and meeting the challenges facing the Union with courage, energy and intellect, but most of all with honor, I will say well done.

There are also dangerous internal risks that, if unchecked, will erode the compliant business practices of the District Council and the Benefit Funds, for example: i) the termination or replacement of compliant and effective employees with cronies and patsies who will yield to the will of thers; (ii) willful and inappropriate tinkering with the Bylaws, Out-of-Work List Rules and policies in place at the Council...

    Irony aside from the ass kissing kudos to your former superior the corrupt & less than honorable Kennth Conboy; the only patsy here Dennis is you for submitting your will & legal requirement to defend the men & woman of the District Council to that of a national racketeer - one Douglas J.McCarron. As far as yeilding to the will of others Dennis, you have perfected the art!

    As for "(ii) willful and inappropriate tinkering with the Bylaws, Out-of-Work List Rules and policies in place at the Council" Dennis that equates to the pot calling the kettle black. Every action that you, Douglas J. McCarron & the alleged U.S. Dept. of Justice-USAO/SDNY office has undertaken in this regard has been wholly illegal and stand in direct contravention to known statute, law(s) and precedent Appellate & United States Supreme Court decisions.

    All of you, inclusive of Judge Berman have far exceeeded any purported authority you may think you had under this private & delusional consent decree & the 2010 Stipulation & Order and all of it from day one has been arbitrary, capricious and a strict abuse of power which none of you possess and you damn well know it.

Termination of ill O'Flaherty and Tim Thatcher It was greed at the beginning of my enure as Review Officer that, rather than having to pay two of my nvestigators as private consultants, they would be employees of he District Council IG's office assigned to my ffice for exclusive and confidential use. This saved the District Council considerable money over he investigators' more han four years of mpeccable service. We ll understood that the District Council reserved the right to end the investigators' employment t the end of my enure. Though I had hoped that the Union would recognize the benefit of keeping two such talented, dedicated and experienced men on staff after I completed my enure, on December 17, 2014, hey were served with notices of ermination (effective December 31, 2014). It is a shame, ince retaining them would have been so easy to do and would have ignificantly improved he caliber of he IG's ffice. To ill and Tim: am eeply grateful for your ingular contributions and your dedicationto truth and duty. You re good and honorable men.

Cronies & Patsies: (2) ther than to collect dues from members (which are in significant part transferred to the Council and UBC n the form of er capita taxes), the raison d'etre for local unions is entirely 15 anachronistic and heir function may be so banal as to defy justification. With he necessary and proper centralization of uthority and business functions at the Council, locals do not represent their members t the bargaining table; they do not employ business representatives; they do not refer members o work.

Cronies & Patsies: Isn't it funny how Dennis Walsh along w/ the USAO-SDNY, Judge Berman of the Federal District Court & Conboy & McCarron readily ignore the fact that the NLRB and the United States Supreme Court have called and ruled the Local Unions to be the pervasive & only recognized bargaining force - yet they or 3+ years after being so apprised readily and illegally ignore the known statute/law(s) and precedent surrounding this very issue. ALA Schecter Poultry by the US Sup. Ct effectively addressed & ended Walsh's centralization argument, yet he still persists in doing McCarron's bidding for him. How long before Wallsh ends up on the UBCJA International pay-roll?

Asset discovery,including depositions, has been largely completed (with multiple defendants claiming penury),but the case, presided over in the Southern District of New York by Judge Loretta Preska, is still some distance away from disposition.

    Sweet, but the real kicker is, the law firm of KMM was wholly inept and they were not abreast or even aware of the the precedent cases in this arena & the only reaosn the case grew legs is due to pro se union carpenters putting the case under Judge Bermans nose via letter & conferencing in June of 2011.

    Dennis - both cases should be un-selaed and made available for member review, less your feigned tranparency record and all be blemished by your hiding of the truth. Try bein honest with the members verses the back room dealing with corrupt players and you may have earned more respect & trust; but neh - you blew it a long time ago when you decided to get into bed with Conboy and Douglas J. McCarron

Dleegates should do a cut & paste hatchet job on his final payment for services rendered as he for the most part was wholly not aorund or present during the last 2-quarters of his appointed tenure (much like no show appointed mob stewards he bitches about herein).

    You just got's to be kidding? At least one of them built a plan table - right.

    WTF did you build other than a liner for Doug's pockets and an agreement with him & the U.S. DOJ USAO-SDNY offices not to prosecute him or his cronies whom you now share a bed with for Hobbs Act criminal racketeering covering all 50-states.
