REPLY MEMORANDUM OF LAW OF MICHAEL BILELLO IN SUPPORT OF HIS PETITION TO VACATE THE VETO OF THE REVIEW OFFICER

Mr. Bilello respectfully submits this reply memorandum of law in support of his petition to vacate the Veto of his continued service as EST, issued by the RO on April 29, 2013.

PRELIMINARY STATEMENT – As discussed below, the RO’s Memorandum in Opposition  is marred by several fundamental legal and logical flaws, which when corrected, underscore the compelling need for relief in this matter. As an initial matter, the context of this Veto is of singular importance: Mr. Bilello was elected by the rank and tile in a successful democratic process that the Order, at its core, is in place to promote. His service has been tireless, honest and productive for the union°s members. Respectfully, it does not advance the interests served by the Order for the “RO process” and its judicial review to countenance unreasonable and unsupported charges, as here, all of which were addressable through reasonable dialogue, rather than the drastic action of veto, and one of which was required by the Order to be addressed through a Court hearing, on notice, not by RO fiat. We accordingly respectfully request that this Court reverse the Veto in the interests of democratic union process; the promotion of respect for law (which the RO’s position herein undermines in two important respects); and to bring reasonable proportion to a set of over-caffeinated and defective charges that should never have required this Court’s time and focus in the first place.

Wow, if you did not know what a puppet the contractor loving Bilello was, you would think Mike did actually try and do something."His service has been tireless, honest and productive for the union°s members." This guy is costing some serious bucks, I am sure rubber stamp berman will dispose of this easily enough.

I do not think it is fair to call mike "contractor loving", sure he had his faults, and I would not see an issue with calling him, spineless, a puppet, two faced, incompetent or many other things, but I do not think it is fair to call him "contractor loving". I do not think that mike gave in to the contractors because he supports them, but because he was inept. I do not think he gave them full mobility because he supported them, but because he lacks any balls to say "no". the same way I do not believe that he intentionally misled members, even though he may have appeared to be trying to hide the facts as to what was occurring, the only fact that he was truly attempting to conceal was that he was in way over his head, and didn't have any clue about what was being asked of him.
      I mean for gods sake, he relied on shady deals Wallace for advice, how can you claim that Mike was making sound decisions when he relied on Wallace? No, poor old Mike did not sell us out, he simply was not up to the job. And remember, that Mike worked off the OWL for almost thirty years, and while some might say that Mike did not give a shit about the OWL when Walsh appointed him as EST, and Mike did not think he would be going on the OWL again, this is not true.
      I think we should all wish Mike well, and thank god he is no longer in a position where he can bankrupt us. Lets just take the millions he cost us and not vote for any more imbeciles.
