Weekly Compliance Message from the EST

The District Council is continuing efforts towards electronic reporting. Currently, Shop Stewards working under the Wall Ceiling, BCA of NY, CAGNY, GCA of NY (Carpenters), the Floor Coverers and the Cement League Association agreements are required to file their reports electronically. I believe electronic reporting has and will continue to enhance the ability of the District Council and Benefit Funds to ensure that employers meet their contractual obligations and members receive the benefits to which they are entitled.

I want to remind Shop Stewards that they can electronically report time in three ways. Stewards can use the tablet device they received from the District Council. Alternatively, they can log on to the Electronic Reporting System through the District Council website from any computer with internet access, or, if they have an iPhone, they can install an easily downloadable “App” and submit time using their cell phone. It is important that Shop Stewards become familiar and comfortable with using one or more of these alternatives to report time.

Some Shop Stewards have been telephoning their time reports to the Job Referral Office instead of reporting electronically. This should only be done in exceptional circumstances and cannot be used as an alternative to reporting electronically. The Job Referral Office is not intended to function as an alternative to electronic reporting. Using it for that purpose undermines the goals of electronic reporting and goes against legal commitments the District Council has made to gain approval of its collective bargaining agreements. Shop Stewards who are required to report time electronically should only call the Job Referral Office to report time in exceptional circumstances, that is, when other means to report time electronically are unavailable (for example, when your tablet device is lost, stolen or broken and has not yet been replaced).

Electronic reporting is a new and I believe a better way for the District Council to do business. Initially it may seem difficult, but it will become easier once we become accustomed to doing it. The District Council is committed to giving every Shop Steward the support they need to become comfortable reporting time electronically. I have included a copy of information given to Shop Stewards when they were trained on using the tablet devices with this letter. I encourage you to review this information and, if you have questions, to call your Council Representatives or the Job Referral Office for guidance at the numbers provided.

Working together we will make this new way of doing business a success and continue our work for the betterment of the District Council and our membership.

Fraternally,
Stephen C. McInnis
Executive Secretary-Treasurer Pro Tem and President

  2. Ex Fed Judge Jones: Here we go again, smoke & mirrors by the D.C. & their so called legal counsel, CEO's & chieftans none of whom, including Judge Jones (Miss $950 an Hour) have any grasp of Basic Labor Law 101 & settled precedents.

    Neither does EST Pro-tem McGinnis

  3. Ex Fed Judge Jones: The Centerpiece of RO Walsh's Compliance Reporting via the Magic Stewie Wands is the ability of the D.C. & the Benefit Funds to accurately track and to collect legally due receivables for member benefits.

Ex Fed Judge Jones: RO Walsh & Judge Jones/McGinnis' tag team policy of ramming the CBA's & Compliance Reporting down members throats fails here: Washington Area Carpenters' Welfare Fund v. Overhead Door Co., 488 F.Supp. 816 (D.D.C.1980), rev'd, 681 F.2d 1, (D.C.Cir. 1982) (trust fund cannot sue employer pursuant to prehire agreement to recover delinquent contributions absent proof of the union's majority status) with Trustees v. Southern Stress Wire Corp., 509 F.Supp. 1097 (N.D.Ga.1981) (holding that Benedict Coal doctrine prevents employer from asserting defense against fringe benefit funds and citing legislative history critical of result in Washington Area Carpenter's Welfare Fund, supra ). But cf. Kaiser Steel Corp. v. Mullins, 455 U.S. 72, 102 S.Ct. 851, 70 L.Ed.2d 833 (1982) (defense of illegality of a collective bargaining agreement is a defense against a union trust fund).

  4. Ex Fed Judge Jones: The Trust Fund cannot sue the Employer to recover your unpaid benefits unless they can prove Sec. 9(a) Majority Status.

"ABSENT PROOF OF THE UNIONS MAJORITY STATUS"........the what?.........The Trust Fund cannot sue Employer pursuant to a pre-hire (Sec. 8(f)) agreement to recover Delinquent Contributions.

Bilello/Lebo/Cavanaugh (Fired, Fired & On Deck to be Fired for the Sec. 21 Extortion Scam) and now McGinnis/Jones/Cavanaugh have not once stepped up and proved Majority Status for any Bargaining Unit.

Instead, Rank & File Members have seen the Blue Card from the Vacation Wage Extortion Scam MORPH into the White Card, the Pre-Hire 8(f) CBA Scam wherein they have Illegally converted your 8(f) CBA pre-hire contracts toSection 9(a) without Proving MAJORITY STATUS TO THE FEDERAL DISTRICT COURT.

THIS IS CORRUPTION, Plain & simple McGinnis. Time to resign before you're fired

    1. Hey, what about electronic reporting in fund contributions, expense account reporting, local meeting attendance, picket duty, and any other union money accountability that will PREVENT waste and corruption. Maybe it will help provide medical to retirees who are being hammered without warning.

I would ask that if you would like to leave a comment that you think of Local 157 Blogspot as your online meeting hall and that you wouldn’t say anything on this site that you wouldn’t, say at a union meeting. Constructive criticism is welcome, as we all benefit from such advice. Obnoxious comments are not welcome.
